Contudo, o munic\u00edpio de S\u00e3o Bernardo tamb\u00e9m recorreu da decis\u00e3o ao Supremo.<\/p>\n<\/div>\n<div>\n<p><!-- banner Ads terra meio responsivo --><\/p>\n<div>\n<p><!-- ads terra native --><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt;\"><strong> LEIA TAMB\u00c9M <\/strong><\/span><\/p>\n<p><script async=\"async\" data-cfasync=\"false\" src=\"\/\/gloriafreeway.com\/38e71d29896801f3b60206f570fc5dcd\/invoke.js\"><\/script><\/p>\n<div id=\"container-38e71d29896801f3b60206f570fc5dcd\"><\/div>\n<\/div>\n<div style=\"text-align: justify;\">\n<p>\u200bA decis\u00e3o do <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">STF<\/a> ser\u00e1 v\u00e1lida para casos de servidoras p\u00fablicas e trabalhadoras da iniciativa privada que estiverem na mesma situa\u00e7\u00e3o do caso analisado.<\/p>\n<p>Conforme a tese que dever\u00e1 ser aplicada a todos os processos semelhantes, se a m\u00e3e pedir a <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">licen\u00e7a-maternidade<\/a> de 120 dias, a companheira poder\u00e1 usufruir de licen\u00e7a de cinco dias, per\u00edodo equivalente \u00e0 <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">licen\u00e7a-paternidade<\/a>.<\/p>\n<p>Ao votar sobre a quest\u00e3o, o <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">ministro Luiz Fux<\/a>, relator do processo, afirmou que, apesar de n\u00e3o estar expressa na lei, o Supremo deve garantir o cumprimento constitucional de prote\u00e7\u00e3o \u00e0 crian\u00e7a. Para o ministro, m\u00e3e n\u00e3o gestante tamb\u00e9m tem direito \u00e0 licen\u00e7a. Decis\u00e3o que for tomada pelo <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">STF<\/a> dever\u00e1 ser aplicada por todos os tribunais do pa\u00eds.<\/p>\n<blockquote><p>&#8220;A licen\u00e7a tamb\u00e9m se destina \u00e0 prote\u00e7\u00e3o de m\u00e3es adotivas e de m\u00e3e n\u00e3o gestante em uni\u00e3o homoafetiva, que apesar de n\u00e3o vivenciarem as altera\u00e7\u00f5es t\u00edpicas da gravidez, arcam com todos os demais papeis e tarefas que lhe incubem ap\u00f3s a forma\u00e7\u00e3o do novo v\u00ednculo familiar&#8221;, afirmou.<\/p><\/blockquote>\n<p>O <a href=\"https:\/\/gloriafreeway.com\/ri88egakkj?key=1dc80be25b87988f146bf972e74c1ad7\">ministro Alexandre de Moraes<\/a> tamb\u00e9m reconheceu o direito \u00e0 licen\u00e7a, mas divergiu do relator para garantir que as duas mulheres da uni\u00e3o est\u00e1vel tenham o benef\u00edcio.<\/p>\n<blockquote><p>&#8220;A Constitui\u00e7\u00e3o estabeleceu uma licen\u00e7a maior para a m\u00e3e, vislumbrando a condi\u00e7\u00e3o de mulher.
